JPA Files to Reverse TMDLs

The Las Virgenes – Triunfo Joint Powers Authority (JPA) has filed a federal court action seeking to nullify the TMDLs for Malibu Creek and Lagoon announced by the USEPA in July.

U.S. EPA Adopts Malibu Creek Regulations

On July 2nd, the U.S. Environmental Protection Agency established new water quality standards for Malibu Creek and Lagoon, which when implemented, will have a severe effect on wastewater treatment costs for customers of the Las Virgenes – Triunfo Joint Powers Authority (JPA), comprised of Las Virgenes Municipal Water District and Triunfo Sanitation District.

Intended to reduce or eliminate the presence of algae in the watershed, the document contains stringent regulations for nitrogen and phosphorous that cannot be met using the existing wastewater treatment processes.

EPA Postpones Announcing Malibu Creek & Lagoon TMDLs

In a statement released Friday May 17, the U.S. EPA said it will extend the implementation of new water quality standards (TMDLs) for Malibu Creek and Lagoon to July 2, “to allow further discussion of the proposed terms of these TMDLs with stakeholders and to address public comments on the proposed TMDLs.” The EPA’s new TMDLs had been scheduled to be established on May 23.

David W. Pedersen, Administering Agent and General Manager for the Las Virgenes – Triunfo Joint Powers Authority (JPA) said, “We appreciate the EPA’s decision to take additional time in considering this important matter, which will have enduring impacts in our service area. The JPA supports actions for the watershed based on sound science that will produce benefits in proportion to their costs.” Mr. Pedersen said he believes the EPA is being responsive to the concerns of the community and allowing more time to consider all the information submitted is an appropriate approach toward building consensus for actions that will benefit the watershed.

The Las Virgenes – Triunfo Joint Powers Authority (JPA), comprised of Las Virgenes Municipal Water District (LVMWD) and Triunfo Sanitation District (TSD) is voicing strong opposition to the U.S. Environmental Protection Agency (EPA) proposal of new water quality standards for Malibu Creek. The JPA has filed a 75-page document with the EPA citing serious flaws in methodology, concerns about potential high costs to meet standards which are unwarranted, given the natural background conditions found in the watershed, and the time frame for public review was very brief. The documents and additional information on this issue, including comment letters, is also posted at www.TriunfoSanitation.com.
